Article 3: Loading and Reloading the Card
Prior to the issuance of the Card and its associated PIN, the Cardholder will be required to load the funds to enable its use.
Article 4: Use of the Card
The amount of each purchase made through the use of the Card or withdrawal of the funds from the ATM will be debited immediately from the Funds of the Cardholder. The Cardholder authorizes the Bank irrevocably to pay all Card transactions by debiting the account. In the event of insufficient funds honoring the requested transaction; the transaction will not be honored and the Bank reserves the right to collect any monies for value of any purchase done by the Cardholder.
Some transactions authorized by the Cardholder may be charged to the Card even though a negative balance may be created. The Cardholder remains in all cases liable towards the Bank for any negative balance on the Card and agrees to pay the Bank overdrawn amount. The Bank will have the right to deduct the overdraft amount from any current or future funds on this Card or any other Card the Cardholder activates or maintains with the Bank.
The Cardholder is responsible for all authorized and/or unauthorized transactions initiated by use of the Card even when the Card is not used by him/her personally. The non-signature by the Cardholder of the transaction sales slip does not release him/her in any case from his/her responsibility for the payment of the amount appearing on the slip. Should any problem arise from purchase made through the Card or should a dispute arise with the supplier involved, the Cardholder must deal directly with the supplier’s own policy on refunds and returns, when entitled to refund.
The Cardholder cannot stop a transaction or payment that he/she authorizes. The Bank is not responsible and does not in any way always guarantee full time functionality and availability of any ATM or POS not owned and controlled by it nor takes responsibility for any interruption or interception or loss of personal information. The Bank will not be held liable for any loss, direct or indirect, that may be suffered by the Cardholder resulting from such.
The Card validity is as per the expiry date, as it appears on the front of the card. It is automatically renewed at the expiration date.
Article 5: Records and Notifications
Upon performing a transaction, the Cardholder shall ensure that he/she obtains and verifies any receipts received. The Cardholder may also get information regarding the balance available funds by calling the Bank’s call center on the following number +961-4-727227 or by checking the mobile application or online through the Website.
In compliance with BDL Basic Circular number 63 and its amendments, the Bank shall automatically send an SMS Alert regarding each executed transaction on the mobile number(s) specifically indicated on the Application Form, unless the Cardholder notifies the Bank in writing its will not to benefit from the SMS Alert , assuming all the responsibilities arising thereof.
In case of complaints and errors, the Cardholder should provide sufficient and correct details in writing to the Bank in order to enable the latter to investigate and to respond.
Article 6: Loss, Theft or Unauthorized Use of the Card and/or Pin.
The Cardholder shall immediately inform the Bank of theft or loss of his/her Card. Any verbal notification must be confirmed in writing against acknowledgement of receipt, within a period of 10 days as of the date of loss or theft of the Card. Upon notifying the Bank, the latter will attempt to block the conduct of further transactions requested. After blocking of the Card and the Pin, the Card cannot be used by the Cardholder again even when he/she finds the same and no refund shall be allowed on the Card.
The Cardholder bears all losses resulting from the fraudulent utilization of the Card and/ or PIN i.e. Theft – loss, etc..; until the Bank receives a written notification of such. If he/she fails to notify the Bank immediately after learning loss or theft, he/she may be liable for all the money in the Card.
Should the lost or stolen Card have remaining balance of money of more than $5 (or C/V), the Cardholder can order a replacement Card with the remaining balance minus a replacement fee as described hereinafter in article 17. If not, the Cardholder shall pay the applicable fees in order to obtain a replacement Card.
Article 7: Limitation of the Bank’s liability
The Bank shall be under no liability whatsoever to the Cardholder in respect of all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses whatsoever arising directly or indirectly out of :
- any use of the Card
- the refusal by any person or supplier in honoring or accepting the Card
- any ATM or POS that malfunctions or is otherwise out of order
- misuse or fraudulent use of the Card by any person including the Cardholder
- handing over of the Card by the Cardholder to a person other than the designated persons of the Bank
- termination right of the Bank
The Bank will not be involved in any disagreement occurring between the Cardholder and the supplier, or between the Cardholder and the companies or establishments, supplier of advantages or facilities by the utilization of the Card. The occurrence of such disagreement cannot in any case exempt the Cardholder from settling the payments he/she made in using his/her card. The Bank will not be involved in any dispute between the Cardholder and the services provider.
Article 8: Fees and Services charges
The Cardholder hereby agrees and acknowledges that all applicable costs, charges and fees in connection with the issue or use of the Card can be deducted automatically from his/her funds. Moreover, if the Cardholder does not use the Card during a period of three (3) months, the Bank has the right to automatically charge his/her account with a dormancy fee in accordance with the charges and fees described hereinafter in article 17.
The costs, charges and fees described in Article 17 will be deducted from the Card funds. The amounts of payments effected in another currency than US Dollars shall be converted into US Dollars at an exchange rate determined by the Bank.
The Cardholder herein agrees to pay and/or authorizes the Bank to debit his/her account with the fees and any charges on the Card as set out hereinafter in article 17. In the event of insufficiency of funds to deduct such costs, charges and fees, the Bank reserves the right to recover same directly from the Cardholder and/or from any accounts maintained by the latter with the Bank.
Article 9: Closing the Card account
This agreement will continue indefinitely unless terminated by either party. The Cardholder has a right to cancel his/her Prepaid Card at any time after the signature of the present agreement.
Should the Cardholder do not want to renew the Card after it expires and / or want to close it, he/she can claim the full remaining balance after deducting a closing account fee as described in paragraph 8.1 above . If the latter does not reclaim the balance within sixty (60) days after the expiry date of the Card, then the remaining balance may be classified as an unclaimed property. All claims will be processed only after the verification of the request and of the requester’s identity. In such case, the Card cannot be used for any transaction and will be placed in a frozen status as of the date the Cardholder notifies the Bank his/her intention to close it.
Article 10: Right to terminate/suspend/ block/decline the usage of the Card
The Bank reserves the right to terminate/suspend/ block/decline the use of the Card/ access to the funds, temporarily or permanently upon the occurrence of any of the following events:
- failure to adhere to or to comply with terms and conditions herein
- event of default under any agreement or commitment entered into with the Bank
- the Cardholder becoming subject to any bankruptcy, insolvency proceedings of a similar nature
Article 11: Security of the Card and the PIN
The Cardholder undertakes to maintain the confidentiality, safety, security of the Card and the PIN. If the latter fails to observe such, he/she will bear any losses suffered as a result of unauthorized use of the Card. Therefore, the Cardholder should not disclose the Pin to anyone, and should not delay in notifying the Bank misuse, loss or theft of the Card and/or PIN.
Article 12: Disputes, Returns and Funds
The Cardholder agrees to settle all disputes about purchases made using the Card with supplier who honored such ,and agrees to accept credits to the Card account in lieu of cash, should he/she be entitled to a refund.
No claim by the Cardholder against the supplier and/or a third party may be the subject of a claim against the Bank. The Cardholder may not assign or otherwise dispose of any rights against the Bank.
Article 13: Personal Information Access
By purchasing the Card, the Cardholder consents and authorizes the Bank to share any personal information on him/her with its branches and appointed agents involved in delivering the application forms and the Cards.
The Cardholder undertakes to immediately notify the Bank of any changes to his/her mailing addresses or contact details.
Article 14: Amendments
The Banks reserves the right to change at any time these terms and conditions, without limitation to, changes which affect existing balances, charges or rates and methods of calculation. The Bank shall notify the Cardholder such amendments in a period not exceeding one (1) month at the adopted domicile. The latter is free to accept these terms and conditions and agrees to adopt them or shall refuse such and asks for the card closure.
Article 15: Jurisdiction and Applicable Law
These Terms and Conditions shall be governed by the Laws of Lebanon. Any disputes arising out of or in connection with these Terms and Conditions shall be submitted exclusively to the Lebanese Courts specifically Beirut courts for settlement.
Article 16: Domicile and Address
For the purposes of execution of the present Terms and Conditions, the Cardholder declares that he/she elected as domicile at the address stated on the Prepaid Card application
